2. These General Conditions of Sale apply exclusively to the online sale of products made on this website in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree no. 70/03) by

Art. 2 - Object 

1. These General Conditions of Sale regulate the offer, the dispatch and the acceptance of purchase orders made on www.maria-diripabianca.com but do not regulate the provision of services or the sale of products by parties other than the seller, for example those present on the same site through links, banners or other hypertext links.
2. Before placing orders and purchasing products and services from different parties, we suggest you check their conditions of sale.

Art. 3 - Conclusion of the contract

1. To conclude a purchasing contract, you need to fill in the form in electronic format and send it by following the relevant instructions.
2. The contract contains the reference to the General Conditions of Sale, the images of each product and its price, the means of payment that can be used, the methods of delivery of the products purchased and the related shipping and delivery costs, a summary of the conditions for the exercise of the right of withdrawal; procedures and times for returning purchased products.
3. Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.
4. The contract is concluded when the seller receives the form filled in by the user, and once the correctness of the data contained in the order is checked.
5. The buyer is obliged to pay the price from the time when the online order submission procedure is completed. This happens by clicking on the "Send Order" button at the end of the wizard.
6. Once the contract is concluded, the seller will process the order for its execution.

Art. 4 - Registered users 

1. In completing the registration procedures, the user must follow the instructions on the site and provide personal data in a correct and truthful manner.
2. Once you have registered, you will receive a confirmation email to the email address you provided. You must confirm within 24 hours at the latest. After this period, in the absence of confirmation, maria-diripabianca.com will be released from any commitment to the user.
3. In any case the confirmation will exonerate maria-diripabianca.com from any responsibility regarding the data you provided. The user agrees to promptly inform maria-diripabianca.com of any change in their data at any time communicated.
4. If the user then communicates incorrect or incomplete data or even in the event that the parties concerned challenge the payments made, maria-diripabianca.com has the right not to activate or suspend the service until the relevant deficiencies are remedied.
5. On your first request for activation of a profile, maria-diripabianca.com will assign a username and a password. maria-diripabianca.com acknowledges that these identifiers constitute the system for validating the user's access to the Services and the only system capable of identifying the user. Moreover, the acts performed through such access will be attributed to him/her and will be binding on him/her.
6. The user undertakes to maintain the secrecy of his access data and to keep them with due care and diligence and not to pass them on to third parties, not even temporarily.

Art. 5 – Product availability

1. Product availability refers to products actually available at the time the buyer places the order. This availability must in any case be considered purely indicative because, due to the simultaneous presence on the site of several users, the products could be sold to other customers before the confirmation of the order. 
2. Even after sending the order confirmation e-mail, cases of partial or total unavailability of the goods may occur. In this case, the order will be corrected automatically, the unavailable product will be eliminated and the buyer will be immediately informed by e-mail.
3. If the purchaser requests the cancellation of the order, by terminating the contract, maria diripabianca.com will refund the amount paid within 29 days from the time maria-diripabianca.com was informed of the purchaser's decision to terminate the contract.

Art. 7 - Loyalty program

1. A point collection program is provided called: Fidelity Card. The program foresees: 20% discount on the tenth purchase.

Art. 8 - Price and payment

1. The price of the products is the one displayed on a case-by-case basis on the website, unless there is a manifest error. 
2. In case of error maria-diripabianca.com will notify the buyer as soon as possible allowing the order confirmation at the right amount or its cancellation. maria-diripabianca.com will not be obliged to supply what sold at the lower price wrongly indicated.
3. The prices include VAT and do not include shipping costs. Prices may change at any time. Changes do not apply to orders for which an order confirmation has already been sent.
4. Once the desired products have been selected, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the required information at each step of the process. The order details can be changed before payment.
5. Purchases made on the site maria-diripabianca.com can be paid by bank transfer, credit card, PayPal Express, Amazon Pay, Nexi-pay or, if available, by Gift Card; if the amount of the purchase does not exceed 400,00 euro, you can also pay in cash at the time of delivery in the Italian territory. 

The cash on delivery method involves an additional cost of 2.50 euros and payment to the courier must be made exclusively in cash (checks are not accepted).

Each purchase transaction is subject to maximum security thanks to the use of the most advanced technological systems in the field of e-commerce and encryption systems (SSL) to protect your personal data and credit card information from unauthorized access. When you place your order, your credit card details are sent to Global Collect and are protected against unauthorized access using SSL ('Secure Socket Layer') encrypted data transfer. This data is not accessible to third parties.

Once the order has been completed, you will receive a confirmation email with your Order Number and a summary of your purchase details. Remember that you can check the status of your order at any time in the relative section of your profile.

Art. 9 - Delivery 

1. maria-diripabianca.com ships worldwide, including the Vatican City State and the Republic of San Marino.
2. maria-diripabianca.com will only deliver to the user's home address provided at the time of purchase.
3. With regard to the Italian territory, the delivery time generally is 24-48 working hours, or, if no delivery date is specified, the goods will be shipped within the period estimated at the time of selecting the delivery method and, in any case, within the maximum period of thirty days from the date of confirmation.
4. Concerning European Union countries, delivery will be made in 3-5 working days, and in any case, within a maximum of thirty days.
5. The delivery to countries outside the EU will take approximately 7-10 working days.
6. If delivery is not possible, the order will be sent to the warehouse. In such event, a notice will specify the place where you find the order is located and how to agree on a new delivery.
7. If you are unable to be present at the place of delivery at the agreed time, please contact us again to agree on a new delivery date.
8. If delivery cannot take place for reasons for which we are not responsible after thirty days from the date on which the order is available for delivery, we will assume that you intend to terminate the contract.
9. As a result of the termination we will refund the paid amount, including delivery costs. Any additional costs arising from the choice of a delivery method other than the ordinary method offered without undue delay will not be refunded. In any case, the refund will be issued within 29 days from termination date of the contract. The transport resulting from the termination of the contract may have additional costs that will be borne by the buyer.
10. Shipping costs are charged to the buyer and are explicitly highlighted when placing the order. 

Art. 10 - Passing of risk

1. The risks relating to the products shall pass to the buyer from the time of delivery. You will acquire ownership of the products as soon as we receive the full payment of all the due amounts, including shipping costs, or upon delivery, if this happens at a later time.

Art. 11 - Warranty and commercial conformity 

1. The seller, in accordance with the provisions of Italian law, is responsible for any defect in the products offered on the site, including the non-conformity of the items with the products ordered.
2. If the purchaser has entered into the contract as a consumer, i.e. any natural person acting on the site for purposes unrelated to his or her business or professional activity, this warranty is valid on condition that the defect becomes apparent within 24 months from the date of delivery of the products; that the purchaser makes a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized; that the online return form is filled in correctly.
3. In the event of non-conformity, the buyer who has entered into the contract as a consumer has the right to obtain the restoration of conformity of the products without charge, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract with regard to the contested goods and the consequent refund of the price.
4. All return costs for defective products will be borne by the seller.

Art. 12 - Withdrawal 

1. In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.
2. In case of multiple purchases made by the buyer with a single order and delivered separately, the period of 30 days starts from the date of receipt of the last product.
3. The user who intends to exercise the right of withdrawal of the purchase may do so by accessing the section: "right of withdrawal" on the www.maria-diripabianca.com website and creating a procedure.
   The user may also send an email, indicating the order number and his/her name, to the following email address: dirittodirecesso@maria-diripabianca.com
4. The buyer must also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or alternatively send the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 not mandatory.
5. The goods can be returned to any store or pick up point on the Italian territory, as indicated on the web page at the time of purchase.
6. The good must be returned intact, in the original packaging, complete with all parts and attached fiscal documentation. Upon verification of compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.
7. As provided by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may suspend the refund until the receipt of the goods or until the buyer has demonstrated that the goods have been returned.
8. The right of withdrawal will not apply if the services and products of maria-diripabianca.com are included in the categories of art. 59 of Legislative Decree 206/2005.
9. The site will carry out the refund using the same means of payment chosen by the buyer during the purchase. In the case of payment by bank transfer, and if the buyer wishes to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary to make the refund.

Art. 13 - Data processing 

1. The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to art. 13 EU Regulation 2016/679 (Privacy Policy). 

Art. 14 - Safeguard clause 

1. Should one of the clauses of these General Conditions of Sale be null and void for any reason whatsoever, this will in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

Art. 16 - Applicable law and jurisdiction 

1. These General Terms and Conditions of Sale are governed by Italian law and interpreted according to it, notwithstanding any other overriding mandatory rules prevailing in the buyer's country. Consequently, the interpretation, execution and termination of the General Conditions of Sale are subject exclusively to Italian law.
2. Any disputes inherent and/or consequent to the same shall be settled exclusively by the Italian judicial authority. In particular, if the purchaser qualifies as a Consumer, any disputes shall be resolved by the court of his or her domicile or residence according to applicable law.
